Important — health and fitness. Anna Fit provides general fitness and mobility training content for informational and recreational purposes. It is not medical advice, physical therapy, or a substitute for professional healthcare. Read the Health disclaimer below carefully.

Agreement

These Terms of Use (“Terms”) govern your access to and use of the website at annafit.co, our waitlist and marketing pages, and our mobile application (“App”) and related services (together, the “Services”), operated by [Your full legal name], doing business as Anna Fit (“we,” “us,” or “our”). Replace the bracketed name with your full legal name before publishing.

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

The Services

Anna Fit offers digital content and tools related to flexibility, mobility, and fitness training. Features may change over time. We do not guarantee that any particular feature, workout, or outcome will be available or suitable for you.

Health disclaimer

You should consult a qualified healthcare professional before starting any exercise program, especially if you are pregnant, have a medical condition, injury, or pain, or are unsure whether exercise is safe for you.

The Services are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
We are not liable for any injury, loss, or harm resulting from your use of the Services or participation in any activity suggested or shown in the App or on our website.
Stop immediately if you feel sharp pain, dizziness, shortness of breath, or other symptoms and seek medical attention if needed.

You voluntarily assume all risks associated with physical activity you perform in connection with the Services.

Eligibility and accounts

You must be old enough to enter a binding contract in your jurisdiction and meet any minimum age required by Apple or other platforms (often at least 13, or older where required). You agree to provide accurate information and to keep your account credentials secure. You are responsible for activity under your account.

We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, or for other operational reasons, with or without notice where permitted by law.

Subscriptions, fees, and payments

In-app purchases and subscriptions may be processed by Apple through the App Store. Those transactions are subject to Apple’s terms and policies, including cancellation and refund rules. We use third-party tools (such as RevenueCat) to help manage subscription status; their processing is subject to their terms and privacy policy.

Website purchases (for example membership or promotional offers) may be processed by Stripe. Payment card details are handled by Stripe; your use of Stripe checkout is also subject to Stripe’s terms.

Prices, taxes, and billing periods will be shown at checkout. We may change pricing or offerings with reasonable notice where required.

Waitlist and pre-purchase

Joining a waitlist does not guarantee when or if you will receive access to the App or any feature. Pre-purchase or promotional offers do not guarantee a specific launch date, feature set, or outcome. If we cannot deliver a paid offer as described, your remedy is limited to what we expressly state at purchase or what applicable law requires.

User content

You may upload or submit content (such as progress photos). You retain ownership of your content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process your content solely to operate, improve, and secure the Services. You represent that you have the rights to grant this license and that your content does not violate law or third-party rights.

Intellectual property

The Services, including software, text, graphics, logos, videos, and other materials we provide, are owned by Anna Fit or our licensors and are protected by intellectual property laws. Except for the limited rights to use the Services as we offer them, these Terms do not grant you any ownership or license to our IP.

Third-party services

The Services rely on third parties (including Google, Firebase, Apple, Stripe, RevenueCat, and hosting providers). Their use of your information is described in our Privacy Policy and their own terms. We are not responsible for third-party services we do not control.

Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ANNA FIT OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE SIX (6) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE PROHIBITED BY LAW (FOR EXAMPLE, LIABILITY FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR STATUTORY RIGHTS THAT CANNOT BE WAIVED).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by applicable law.

Indemnity

You agree to defend and indemnify Anna Fit and its operator against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services, your content, or your violation of these Terms, to the extent permitted by law.

Governing law and disputes

These Terms are governed by the laws of the State of [Your U.S. state], United States, without regard to conflict-of-law rules. You agree that courts located in [County, State] (or the federal courts with jurisdiction there, if applicable) have exclusive jurisdiction over disputes, except where consumer protection law requires otherwise.
